Terms & Conditions

These Terms & Conditions explain the rules that apply when you use our website, contact us or book a private experience with Private Guanacaste by Mario.

By confirming a booking or participating in an experience, you agree to the terms that apply to your selected activity.

Introduction

These Terms & Conditions apply to the Private Guanacaste by Mario website, enquiries, reservations and private experiences.

“We”, “us” and “our” refer to Private Guanacaste by Mario. “Guest”, “you” and “your” refer to the person making the booking and all participants included in that booking.

The person making a reservation is responsible for sharing these terms and all relevant tour information with the other members of the group.

Enquiries and bookings

Sending an enquiry does not guarantee availability or create a confirmed booking.

A reservation is confirmed only after we have agreed the date, experience, group size, price and any required deposit or payment. Confirmation may be provided by email, WhatsApp or another agreed communication method.

Please review your confirmation carefully and tell us promptly if any information is incorrect.

Prices and payment

Prices may depend on the selected experience, date, group size, pickup location, transport requirements, boat size, guide availability and any additional services requested.

We will explain what is included before you confirm your booking. Unless stated otherwise, personal purchases, food, park entrance fees, gratuities and optional extras are not included.

  • Payments must be made using an approved payment method.
  • Any required deposit will be explained before confirmation.
  • A remaining balance may be due before the experience or on the day, depending on the agreed arrangement.
  • Guests are responsible for any bank, card or currency-conversion charges applied by their payment provider.

Changes and cancellations

Please contact us as soon as possible if you need to change or cancel your booking.

The applicable cancellation and refund conditions may vary by experience because boats, drivers, guides, entrance tickets and other services may be reserved specifically for your group.

Example: cancellations made more than [number] days before the experience may receive [refund percentage]. Cancellations made later than this, or failure to attend, may be non-refundable.

Requests to change dates remain subject to availability and may result in a price adjustment.

Weather and local conditions

Experiences in Costa Rica are affected by weather, ocean conditions, tides, road conditions, wildlife activity, park restrictions and other circumstances outside our control.

For safety or operational reasons, we may adjust the route, departure time, activity, transport, boat or itinerary. Alternative locations or activities may be offered where appropriate.

Rain alone does not necessarily mean that an experience will be cancelled. Decisions are made according to the actual conditions and the advice of the relevant captain, guide or provider.

Guest responsibilities

Guests are responsible for:

  • Providing accurate booking and contact information
  • Arriving at the agreed time and pickup location
  • Informing us about mobility limitations, allergies, medical conditions or other relevant needs
  • Following reasonable safety instructions from guides, captains, drivers and activity providers
  • Supervising children in their care
  • Bringing suitable clothing, footwear, sun protection, medication and other recommended items
  • Treating local communities, wildlife, staff and the environment respectfully

Guests must not participate while impaired by alcohol, illegal drugs or any condition that could create a safety risk.

Health, safety and participation

Outdoor, ocean and wildlife experiences involve natural and unavoidable risks. These may include uneven terrain, slippery surfaces, currents, waves, weather changes, insects, animals, transport risks and limited access to medical assistance.

Participation should be appropriate for your health, fitness, swimming ability and comfort level. Please ask us before booking if you are unsure whether an experience is suitable.

For safety reasons, a guide, captain or provider may refuse or end participation where instructions are ignored or continued participation presents an unreasonable risk.

Third-party providers

Some experiences may include services operated by independent providers, such as captains, boat owners, drivers, guides, photographers, parks, restaurants or activity operators.

Where applicable, their own operating rules, safety requirements and cancellation terms may also apply.

We select and coordinate providers with care, but individual providers remain responsible for the services they operate.

Responsibility and liability

Nothing in these terms excludes or limits rights or responsibilities that cannot legally be excluded.

To the extent permitted by applicable law, we are not responsible for losses caused by events outside our reasonable control, including severe weather, natural events, road closures, park restrictions, transport disruption, mechanical problems or actions of independent third parties.

Guests remain responsible for personal belongings throughout the experience. Please avoid bringing unnecessary valuables.

Travel and activity insurance is strongly recommended, including appropriate medical, cancellation and personal-accident coverage.

Children and families

Children must be accompanied and supervised by a responsible adult. The adult making the booking is responsible for confirming that the selected experience is appropriate for the children in the group.

Age, height, swimming ability or safety restrictions may apply to particular activities or equipment.

Photography services

Photography may be available as an optional addition to selected experiences. Availability, duration, deliverables, editing style, delivery time and price will be agreed separately.

Personal photographs will not be used publicly for promotional purposes without appropriate permission.

Natural conditions, weather, lighting, access restrictions and guest cooperation may affect the final images.

Website use and content

Website descriptions, images, routes and examples are provided for general information. Individual experiences may vary according to season, conditions and availability.

Website text, branding, photography and design may not be copied, republished or commercially used without permission, except where content belongs to an identified third party.

Links to third-party websites are provided for convenience. We are not responsible for the content, security or policies of those websites.

Complaints and concerns

Please contact us promptly if you experience a problem. We prefer the opportunity to understand the concern and try to resolve it directly.

Include your name, booking date, selected experience and a clear description of the issue.

Applicable terms and updates

Additional written conditions may apply to a specific experience. Where they differ from these general terms, the conditions provided for that booking will apply to the relevant service.

We may update these Terms & Conditions when our services, suppliers or operating practices change. The latest version will appear on this page with its revision date.
